Due to the ongoing COVID-19 level 4 lockdown, it appears that many of Lanseria’s businesses will not be able to return to normal activity during the month of May. Now that EAA AirVenture 2020, Oshkosh has officially been cancelled for 2020, African Pilot will fast forward its annual Light Sport Aircraft feature, but this time with a considerable difference in that we will explore the many LSA types well beyond what have been traditionally available in this country. Also, due to the present COVID-19 situation we have decided to delay the production of African Pilot’s annual Aviation Services Guide to later in the year.

COVID-19 and government regulations
The following is the latest information from the Department of Transport (DoT) and how this affects the Aviation Industry and Industry as a whole.
5. Charter flights
Transportation by charter domestic flight of mining products as set out in Annexure C of the Regulation and staff performing mining essential services are permitted.
6. Compliance with disinfection measures
(1) Aircraft Maintenance Organisations and Aviation Training Schools are required to submit procedure to the, Civil Aviation Authority and the procedure must demonstrate measures they are going to put in place in order to eliminate the risk of spreading COVID-19.
(2) No person will be allowed to enter a building, place or premises if they do not wear a cloth face mask or a homemade item that covers nose and mouth.
(3) Air Service Operators must put measures in place to adhere to physical distancing to curb the spread of the virus. This gazette is also available free online at www.gpwonline.co.za
(4) Air Service Operators must put in place procedures for cleaning and disinfection of their premises on regular intervals.
7. Engineers and ground staff, inspections and servicing of aircraft at airport hangars
(1) Aircraft Maintenance Organizations (AMOs) are allowed to conduct aircraft maintenance
(2) Aircraft flights for the purpose of positioning aircraft for maintenance are allowed
(3) Flying for purposes of conducting flight tests and ground engine runs are allowed
(4) For the purposes of conducting maintenance related flights, approval from the Civil Aviation Authority (SACAA) must be obtained.
8. Aviation Training
Aviation Training Schools are allowed to conduct aviation training to students using ‘virtual platforms.’
9. Exemptions and Approvals
All exemptions or approvals related to the COVID-19 Minister’s Regulations and associated directions must be submitted to the Department of Transport (DoT).
Resumption of training and e-learning
‘Virtual platform’ as published in Government Gazette 43271
The Minister of Transport has taken the regulations promulgated by the Minister of Corporate Governance and Traditional Affairs published on 30 April 2020 and formulated his own regulation with regard to the transport sector. This has resulted in the publication of new regulations in the Government Gazette 43271 dated 4 May 2020.
1. Applicability: This notice is applicable to all Aviation Training Organisations (ATOs) approved in terms of the Civil Aviation Regulations, 2011 (as amended).
2. Purpose of this General Notice: This General Notice serves to address training conducted by all aviation training organisations approved in terms of the Civil Aviation Regulations, 2011 (as amended).
3. Background: On 15 March 2020, the President of the Republic of South Africa declared a national state of disaster regarding the COVID-19 outbreak. In this regard, the President also put in place several measures with the intention of limiting exposure and the potential spread of the virus. On 23 March 2020, in furtherance of the management of the state of disaster, the President declared a 21-day national lockdown effective 26 March 2020 at midnight. On 9 April the President further announced an extension of the lockdown up to 30 April 2020. Furthermore, on 23 April 2020, the President announced the easing of restrictions of the lockdown to Level 4 from 01 May 2020, which would allow businesses to open the workplaces for a limited number of employees to return to work. The objectives under Level 4 means taking ‘extreme precautions to limit community transmissions and outbreaks, while allowing some activity to resume’. To this effect, the office of the Presidency published a summary of the alert levels linked to the different phases and this will be made available on the SACAA website. The phases stipulate the objectives for each phase and the sectors permitted to operate under each phase. Applicants have referred to the Proposal for Phased Economic Recovery dated 22 April 2020 in order to commence training at Level 4 and have conducted a risk assessment in mitigation of their appeal.

Commencement of training at ATOs / e-learning
from the SACAA
Several Aviation Training Originations (ATOs) have made representation to commence training and / or to train on-line, but not in the way envisaged by the impeding eLearning regulations. South Africa is currently on Level 4 of the lockdown status and training will only commence under Level 3. Applicants have referred to the Proposal for Phased Economic Recovery first sighted in pptx (I don’t know what this means) form on 22 April 2020 to commence training at Level 4 and have conducted a risk assessment in mitigation of their appeals.
The SACAA cannot provide clearance, guidance or an approval on the matter of schools opening for normal business again, since the Minister of Transport has to take the regulations promulgated by the Minister of Corporate Governance and Traditional Affairs as published and formulate his own regulation with regard to the transport sector. Only once this is done, the SACAA will publish regulations dealing with the way forward. When quoting self-conducted assessments of risk as per to the proposal for phased economic recovery, no reference was made to support services, especially for those conducting flight training, of how the resumption of their activities will impact on other services such as AMOs, AMEs, airfield operations, emergency services, ATS services, spares suppliers etc. All these aspects will have to be considered by the SACAA before the DCA makes a recommendation to the Minister in her regulations.
For those ATOs wishing to conduct eLearning, then those ATOs which have been given an eLearning prior to Lockdown, then it is business as usual and they may proceed. Arguments have been given by ATOs on the urgency or the need to conduct training for other licensing issues by offering a form of eLearning. Please bear in mind that the SACAA has granted a general 90-day exemption which expires end of July 2020 for all licences and ratings required by an individual to operate. This would include aspects such as CRM and Dangerous Goods, SEPT etc. The argument in many appeals and the necessity to continue training due to licences and ratings expiring is not viewed as a valid reason to deviate from current practices and future proposed practices.
Until further notice is given then the following should be applied:
The Part 141 regulations and Technical Standards have been proposed by the SACAA and have been workshopped extensively with industry over the past two years and participants in the working groups gave their approval on 3 March 2020 for the SACAA to recommend to CARCOM for ratification by the Minister. In the past year, the SACAA has used the proposal, with refence to Subpart 7 eLearning, in the absence of regulations or standards, to grant interim approval to ATOs to provide eLearning. The SACAA has faith that these regulations will be published soon, therefore the SACAA will not grant approvals that fall outside of these proposals.
During the past month, interim approval was granted to some ATOs to conduct limited distance learning using the internet and whatever platform they have available. These interim approvals will automatically fall away once government approval is granted to commence training as the interim requests probably do not comply with current regulations regarding facility requirements and the current approval of their curriculum. Where an ATO does or did not have the capability to deliver via an eLearning platform, the SACAA granted interim approval to conduct distance learning through whatever method they requested using common sense when granting the approval. No exams were to be written, if not on an approved eLearning platform. This meant training can take place, but assessment according to the risk matrix in CATS 141 shall take place.
In seeking an approval to conduct training ATOs are to make an electronic submission to PEL.Training@caa.co.za together with application form, proof of payment and of course all the attached documents for amendment to the ATO TPM and to follow the guidelines for eLearning as proposed to approve an eLearning course. The challenge for AME Training lies in the proposed regulation ME Type Ratings in excess of 5700kg. Please see the proposed CAR 141.07.1(3). For those ATOs wishing to have an eLearning platform together with the curriculum approved, this will involve an onsite visit and a demonstration of the envisaged platform. This process can only be completed at Lockdown level 3 unless otherwise regulated in the next few days.

I received this very poorly written notice from the SACAA, therefore I have edited the text so that you can make some sort of sense about what is contained therein. I will continue to monitor the information that has been kindly sent out by the Commercial Aviation Association of South Africa (CAASA), which is the correct aviation body that is mandated to represent all its members within the various sectors of commercial aviation. Aviation Training Organisations (ATOs) form one of the sections of CAASA and the interests of ALL ATOs, even if they are not members of CAASA is being managed by experts at CAASA who have been engaging with the SACAA and DoT on a regular basis.
Police corruption during lockdown
“Great leaders lead with influence and by setting good examples”

Some police officers have disregarded regulations and committed crimes during the National Lockdown.
• Approximately 131 public officials have been arrested during the national lockdown, 89 of those were police officers.
• Police officers are particularly prone to bribery and corruption charges – Police usually charge between R1 000 and R3 500 for bribes, some officers will settle for less.
• Police officers sometimes only ask for food or beverages as a bribe.
• It is worth keeping in mind that corrupt officials and criminal syndicates are bound to find new opportunities to commit crime.
• As a result of the national pandemic, corrupt officials and criminal syndicates benefit from border closures, commodity shortages, delayed court proceedings and other disruptions.
Types of crimes committed
• Violation of National Disaster Management regulations
• Confiscation of liquor and then re-selling the liquor
• Involvement with illegal enterprises
• Transportation of liquor and cigarettes
• Drinking at taverns
• Theft of cash.
Shocking incidents that have already been reported during the lockdown period
• In Mpumalanga: two Pienaar police officers were arrested for using a state vehicle to escort a tavern owner’s three bakkies, each loaded with liquor
• In Bonnievale: seven police officers (two sergeants and five constables) were arrested for attempting to break into a liquor store
• Three officers from the Tshwane Metro Police Department (TMPD) were recently arrested for extorting a bribe from a motorist in Pretoria
• Six officers from the Brooklyn and Silverton Police Stations in Pretoria were arrested on Saturday after members of the Mpumalanga Provincial Anti-Corruption Unit received information that the officers had stolen over R30 000.00 in cash from a group of people passing through a roadblock.
As a member of the public
• It is the responsibility of each citizen to address police-related corruption
• Refuse to engage in any sort of crime that involves police officers
• Refuse to pay a bribe even if it means being fined
• When you refuse to pay a bribe the police officer will often let you go
• Police officers will continue being corrupt if they know that they can get away with this
• Refuse to be complicit and report police corruption immediately.
It is important to take note of the police officer’s name and his vehicle registration number
Actual police corruption that was reported in Midrand
A paramedic offered her elderly neighbour a lift to the shops, because her car was not starting. When the shopping was concluded the pair of ladies returned to their nearby estate but were stopped in a roadblock. They were both wearing the required masks and they were not breaking any laws. The paramedic, who was dressed in civilian clothing at the time had the correct paperwork with her. The police were shown the shopping bags and the grocery store receipts, but despite this, they arrested the elderly neighbour who was detained overnight in the Midrand Police cells. The next day, the paramedic now dressed in her flying overalls, went to the Midrand Police Station to bail out the elderly lady who had spent the night in a cell filled with other people. When the SAPS saw the paramedic in her flying overalls, they jumped to attention and released the lady, but not before a formal complaint had been laid with the officer commanding this station. This certainly smacks of police brutality, which has become rife all-over South Africa.
Second case of Police brutality
A man was driving to the shops alone in his vehicle, when he was stopped by the SAPS. At the time, his face mask was on the passenger seat. As he stopped, he placed his mask over his mouth and nose. He observed that some of the police officers were not wearing masks as required by law. He was arrested and no matter how much he protested, they would not listen to him. After spending several hours in a crowded police cell together with numerous other people, he was released without being charged. Please everyone, please ‘wear your masks even if you are alone in your vehicle!’
WORLDWIDE ACCIDENTS AND INCIDENTS
Embraer 120 carrying medical equipment crashes in Somalia, six dead
An African Express Airways Embraer EMB-120RT crashed while approaching Bardale airport in southwest Somalia, killing the six people on board. The aircraft, registered 5YAXO, took off from Mogadishu Airport (MGQ) and was transporting medical supplies destined to fight the coronavirus pandemic to Baidoa Airport (BIB), in the southern Bay region on 4 May 2020. Reports say it had been chartered by a non-governmental organisation. Onboard were two pilots and four passengers. Photos from the crash site outside Bardale town. All six people on board are dead. The plane was five kilometers away from its destination airport and had commenced its descent when it crashed, killing all occupants. The causes of the accident are being investigated.
It has now been reported that the plane was brought down by RPG in Bardale town, which is controlled by Ethiopian forces, although investigations are continuing. Apparently, the plane was due to land in the town and was believed to have been ferrying miraa to the town. African Express is owned by Captain Musa Hassan Bulhan, a career pilot and one of the pioneer aviation entrepreneurs in Kenya. Captain Bulhan is known to be one of the first Africans to own an aircraft in the continent.
President Farmajo calls Uhuru to express regrets after the a was brought down
In a statement to newsrooms, the Foreign Affairs Ministry said Farmajo made a phone call to President Kenyatta on Tuesday morning to inform him that he had ordered investigations into the incident. According to the ministry, President Farmajo extended an invitation to the Kenya Civil Aviation Authority (KCAA) to team with their Somalia counterparts to help with the investigations. Two pilots who died in the crash have been identified as Captain Mabruk Sherman and Omar Chiraghdin from Mombasa.
Another report said that the aircraft was supporting humanitarian operations during the Covid-19 pandemic. A warning has been issued that the incident could affect humanitarian activities in Somalia, the ministry appealed to all Kenyan and other humanitarian aircraft operating in the region to enhance extra precaution considering the incident. KCAA Director General Capt. Gilbert Kibe said the Africa Express’ operations officer told the authority that they lost contact with the aircraft at 16h20 on Monday.
This aircraft had been operating in Somalia since 2 March 2020.
